I'm sure my brother was in a similar situation a few years back with a huge garage that may or may not have had planning permission due to it's closeness to a road. I thought he took out "extra" indemnity insurance to cover it.

I had a bit of a farse over having my drive done the council were arses over it and said we needed to get permission from the highway dept, after contacting them, they kinda questioned as to why i had called them as it was not needed. However i am sure i will come up against this soon as may be putting our house up for sale so i am sure the fun will commence then too.

what does your solicitor say? have they been able to offer any advice.

apart from that, i really just dont know what advice to offer- although a good shout and rant really will make you feel better. the physical release of tension is very liberating.

It currently stands that the lender needs 'something' to prove the council won't rip it down if they notice it. The council say records don't go that far back, so they couldn't do so anyway. The lender still wants something, the council can't give anything.

Apparently the only way forward is indemnity insurance, but that can't be had because we actually asked if a certificate was in place. Just by asking you are in fact removing any chance you have to get around there not being one. Seriously, is that fooked up or what?

Surely the council can say (in writing) that they can't require removal as it predates the existing records? They admit that they can have no basis for condemning it, surely, and they have told you that. These (self)important people are merely trying to get you to 'solve' a non-existant problem.

I spent an angry 30 minutes on the phone last night to the lender, just repeating constantly 'So what bit of paper actually existed in 1976 that you will accept, so that I can find it?'. Seems they don't know, but want 'something'.

The underwriter is to call my solicitor today apparently, but I've just had enough of the whole thing. I'm not convinced that anybody actually knows what they are doing, as everyone seems to have a different rulebook. There MUST be a procedure for houses with extensions built prior to November 1985, yet nobody seems to have a fookin clue! I agree the council should be able to provide something, but as its not my house its hard getting this information from them - or even if its something they will actually do!

You are indeed correct in assuming that they don't know what they're doing. House buying involves a lot of spurious 'problems' which devolve down to the person with the lowest status - in this case the person who is actually paying for it! You might try moving up the food-chain with the lender and asking someone in authority why you are being stopped from giving them even more money by an employee who is insisting on seeing a spurious, worthless and, probably, non-existant piece of paper? If they can't define what they require then how will they know when they've seen it?

I am constantly surprised how rarely that happens. A lot of these people are useless, pointless parasites who will obstruct you whilst you struggle to give them even more of your money for complicating a simple issue....

Nobody would miss them.

OK, seriously, is someone trying to send me bi-polar?

After the big fat no yesterday, I got a call from a firm I contacted yesterday regarding indemnity insurance. They think that despite contact being made with the other parties involved, they can still offer indemnity due to the age of the construction. We shall see.

House buying aint stressful at all, oh no. I really want to shoot someone, in the FACE!

Now, be sensible! Shoot them in the hips and shoulders, then they will suffer nearly as much as you have. Or use a cordless drill so that you don't risk damaging your hearing. Safety first!

Called my solicitor today, she wasn't in. She stopped working there on Friday! Bit of a suprise to say the least, but the others know whats going on. Unfortunately tomorrow is end of funds day, and still no indemnity insurance, but luckily the people dealing with funding have said they'll give me a bit longer.

So it continues....

And for todays "Lets make tek slash his wrists" installment, my mortgage ran out and they wouldn't let me extend. They'd let me have a worse deal (5 years only at higher rate), but not my 10 year. Spent an hour going backwards and forwards, I can keep it for 2 weeks.

Its all a larf, innt!

sorry to hear about your continued woes, homes.. at the moment, is it really starting to look like the whole deal has gone tits-up for realzies? or is there still hope?

Cheers mate. There is still hope, but I feel like the light at the end of the tunnel is a strobe. If it'd just make up its mind!

Anyway, 2 weeks and thats final. After that, I'm stuck renting again, so lets see what else they can throw at me.
