Samsung to pay $1bn in damages to Apple

It's getting silly now.

Maybe we all ought to stop buying Apple and Samsung products? Nah, it'll never happen.

High Court judge declares Samsung to be 'not as cool' as Apple. http://www.bbc.co.uk/news/technology-19989750

But Apple still has to run adverts saying that Samsung didn't copy them...
Having to run the adverts is just ridiculous. We all know that Samsung copied Apple with their first smartphones after iPhone was released. Proving it in law is another matter altogether.

As I said before, it's all getting silly now.

I'm not sure I agree with that statement to be hones, what exactly have they copied? If it can be proven at all, it can be proven in law surely?

But yes, its all very silly.

The first Galaxy phone. I've seen people mistake that with an iPhone, in fact, I've even done it myself.

Did anyone see the launch of the new iPad mini yesterday and the new iPad 4 and other Apple shizzle...?

Apparently they spent a lot of time trash talking the Google Nexus 7 from an iPad Mini point of view... most of it all seems to be b*ll*cks though... the usual "we're better than the competition (but only in our own little fairytale world)" stuff....

This seems an unbiased view on the reality:

we're talking about two very different types of devices -- with two very different value propositions. We're also talking about two very different platforms and ecosystems, each with its own set of pros and cons.

It's playing in a completely different field -- and regardless of which platform you prefer, that's perfectly fine.

Are you sure that's a tech review? Sounds like far too much common sense being shown to me.

What Apple failed to mention is the fact that the Nexus 7's screen has a higher resolution than the iPad Mini's -- 1280 x 800, 216 ppi, vs. the iPad Mini's 1024 x 768, 163 ppi -- and that the Nexus 7 packs a cutting-edge quad-core processor while the iPad Mini is using last year's dual-core A5 model (essentially what was in the iPad 2).

I'm seeing a lot of talk about this odd screen choice, but I've figured it out I think. They used the same as the ipad2 because it meant apps designed for the ipad2 would look right, plus of course run the same as they have the same CPU. Lets face it, the ipad mini is a shrunken ipad2. So while the screen is a bit on the naff side compared to any premium android tablet, it means no more work required to sell apps to the punters. They'll make about £100 per unit sold profit, and then be able to fleece people immediately with a full quota of apps as well. Laughing.

Apple's statement on its website said:
Samsung / Apple UK judgment

On 9th July 2012 the High Court of Justice of England and Wales ruled that Samsung Electronic(UK) Limited’s Galaxy Tablet Computer, namely the Galaxy Tab 10.1, Tab 8.9 and Tab 7.7 do notinfringe Apple’s registered design No. 0000181607-0001. A copy of the full judgment of the Highcourt is available on the following link www.bailii.org/ew/cases/EWHC/Patents/2012/1882.html.
In the ruling, the judge made several important points comparing the designs of the Apple and Samsung products:
"The extreme simplicity of the Apple design is striking. Overall it has undecorated flat surfaces with a plate of glass on the front all the way out to a very thin rim and a blank back. There is a crisp edge around the rim and a combination of curves, both at the corners and the sides. The design looks like an object the informed user would want to pick up and hold. It is an understated, smooth and simple product. It is a cool design."
"The informed user's overall impression of each of the Samsung Galaxy Tablets is the following. From the front they belong to the family which includes the Apple design; but the Samsung products are very thin, almost insubstantial members of that family with unusual details on the back. They do not have the same understated and extreme simplicity which is possessed by the Apple design. They are not as cool."
That Judgment has effect throughout the European Union and was upheld by the Court of Appeal on 18 October 2012. A copy of the Court of Appeal’s judgment is available on the following link www.bailii.org/ew/cases/EWCA/Civ/2012/1339.html. There is no injunction in respect of the registered design in force anywhere in Europe.
However, in a case tried in Germany regarding the same patent, the court found that Samsung engaged in unfair competition by copying the iPad design. A U.S. jury also found Samsung guilty of infringing on Apple's design and utility patents, awarding over one billion U.S. dollars in damages to Apple Inc. So while the U.K. court did not find Samsung guilty of infringement, other courts have recognized that in the course of creating its Galaxy tablet, Samsung willfully copied Apple's far more popular iPad.

Apple may as well write it in Comic Sans. Joke font for a joke verdict by a joke judge.

Maybe they should determine what the other tablet copied exactly, and more people may feel lenient towards them. It is after all the buying public that matter here, not the courts. Although nearly every apple fan I know is looking to jump ship after the iphone 5 was released, none are impressed and don't want to wait another year for the next increment.

The Queen will add the first tablet computer to the Royal Collection when she is presented with a "digital time-capsule" later.

Doesn't look like she has chosen the Samsung.... :heyhey:

I'm pretty sure she couldn't give a monkeys what she was given, its a tablet. Interesting that the people involved in the project chose the samsung though, given that a UK designer was involved in the ipads. Maybe they just couldn't commit to an overpriced product in these times.

On a side note I heard the other day that Samsung have upped the price of its processors to Apple by almost 20%, which should nicely pay off the $1bn they are supposed to pay apple from apples own pocket.

The Queen probably isn't bothered. Maybe Samsung have given the project the tablet to get a bit of publicity. Who knows?

I'd heard that Apple said no to the price rise, couldn't find anyone else to supply the processors so then had to agree to the increase. The tech industry is so incestuous that it's amazing that they sue each other.

Yeah, that's what I heard too. Funny really, apple rely heavily on a firm yet attack them. Surely they expected retaliation? I suppose they hoped Samsung would be too scared of losing their custom, but they picked a time to do it when Samsung are more profitable than ever so could afford to take a hit.

To badly misquote Frank Herbert, to have the means to destroy something gives you control over it. Apple need to diversify their hardware a bit. Relying on your primary competitor is madness.
