Out of interest, could the police prosecute you for parking in a disabled bay without a disabled badge? I saw this about 20 minutes ago at Asda:

Disabled bays in private car parks have NO legal standing. Asda or the company operating the car pack could give them a ticket but i'd never stand up.

Still out of order though, would send it to the cops.... (and expect a letter back saying "it was an emergency - the stations stock of doughnuts had run out"

Asda car park is there own b&q once got a telling off for window flying leaflets. I would certaily send it on to stafford police station as it is yet another liberty they take, I use the mother an child bay when with the wife and kids but never on my own, it is there for a reason

Sorry dude, As a parent they do come in handy but if i wasn't i would think wtf. With a 2 yr old an a 6 yr old to follow its needed. My kids would happily run in front of traffic if i took my eyes off them, Not good

I wish they would ticket people. My husband is disabled and I can't tell you how many times we have had to park far out because some stupid person parked in the disabled bay just to go to the money till at Tesco.

It is something that angers me to no end!

I have no issue with there actually being parent and child bays, I understand why there is a need for them. I just don't understand why they have to take up so many of the spaces right outside the store. Why not put them at the far end of the carpark where there is plenty of space. That way you could have a double width space and theres little danger from passing traffic.

Disabled spaces are where they are because disabled people might have trouble walking long distances....... parents and child didn't last time I looked (else they would be in the disabled spaces).

As an able bodied hetrosexual white male I feel like a second class citizen when I park in Tesco :D

I really understand your concerns francis, I think they just don't bother because they know the tickets have no legal standing.

Same as if you get a ticket for staying over two hours in Asda or Tesco, just ignore it as it wouldn't stand up in court and they know it. They just rely on peoples conformity to pay them.

oh my god, you are making perfect sense, i can't believe i never thought of it like that! i've never had a problem with parent & child bays, and always thought "fair enough, let 'em have 'em," but it really would make more sense if they operated in the way you have suggested..

They do have some standing, but not the same as a fixed penalty noticed issued by a traffic warden in a public car park or on the highway which are issued in accordance with the Road Traffic Act and so on.

On private car parks, tickets issued are based on contract law that when you enter a car park the driver enters into a contract with the car park owner or their agent, as per any terms they put up on a notice. If you breach the terms they issue a ticket. Where it could get difficult for them is that you are not required to divulge who the driver was - though if they happen to have proof (CCTV, whatever) they could pursue you through the small claims court on breach of contract.

the photo does not prove that the car was stationary, so persuance would be a complete waste of time........

Yes, it is.
Didn't you know that the plod operate a taxi service? Sometimes you even get a free hotel room for the night.

I did have a leaflet about their hotel service - I will see if I still have it.
