Some interesting updates on that thread now, looks like the judge doesn't like ACS:Law at all!

He then went on as to why wasted costs would be applicable - I couldn't keep up with my note taking, but he talked about the fact that MediaCAT was not an exclusive license, that the copyright holder was not a party to the proceedings and that all parties needed to be joined. he then went on about tens of thousands of letters sent out demanding monies totally out of proportion to damages and costs. Cited Sheppenhurst & MediaCAT agreement (which Rali had requested from MediaCAT) whereby the solicitor gets 65% of all monies received after costs. Copy handled to Judge who had not seen it before. He said that such an agreement was contrary to the Solicitors Code of Conduct. The letters sent where wholly flawed in terms of the law and an abuse of the process for these types of proceedings that were conducted. The appropriate remedy in such an instance is the wasted costs remedy. In applying for an order for wasted costs, Tritton stated that these should be "off the scale". he then cited 45.412a - sacle costs not restricted where than has been abuse of court and 63.262 where parties had behaved unreasonably. Also concerned that MediaCat don't have the funds.

Judge Birss said:

Things are looking bleak for ACS:Law now :D

LimeWire Pays RIAA $105 Million, Artists Get Nothing

In the midst of their jury trial, the company behind the defunct LimeWire client and the RIAA settled their dispute out of court. Limewire will pay $105 million to compensate the major music labels for damages suffered. A moment of justice for the music industry, but not necessarily for the artists. The recouped money is destined for reinvestment in new anti-piracy efforts and will not be used to compensate any artists.

According to the injunction that shut down LimeWire last year, the company “intentionally encouraged infringement,” its software was used “overwhelmingly for infringement” and the company knew about the “substantial infringement being committed” by LimeWire users.




So now the RIAA can invest millions in anti-piracy efforts (meaning DRM and other nonsense) and continue to punish the people who actually pay for the products - in short they can do a SONY.

All it does is scare the computer illiterate into buying dodgy copies, thereby actually putting money into someones pocket. Everybody knows somewhere they can get pirate copies before the dvd release.

Let's just say there are certain places where on certain days people openly sell copied films, and appear to make a rather tidy profit. I'd hazard a guess that if the same person worked 3 evenings a week for 2 hours a time they'd be earning more than me doing a legit 9-5. Depressing really!

Agree - torrent != piracy.
Torrent = an ingenious method for crowd sourcing data distribution.

The fact that it got embraced by bootleggers and not mainstream media distributors probably says more about those two groups than it does the technology.

If the BBC released iPlayer programs as .tor that a user could download from multiple clients across the UK/Globe that would increase speed. Apply the same approach to streaming media and nobody gets laggy episodes.

Mainstream media companies should embrace technology - technology is not going to stop just because their business model can't work out how to put a £££ on it.
