Dirrerent things are getting mixed up in this message. The basic premise is that, in the case of downloads without making payment to the IPR owner, the service provider will have to help that owner identify the correct people to approach to seek payment. This is all a matter of civil law and there is no question of people being judged guilty. If there is a dispute about liability, it has to be resolved. The prospect of disconnecting people's internet access might at some point in the future become a possibility once that process has been exhausted but for the power even to come into effect there would have to be further, secondary legislation (the so-called "Super Affirmative" variety) to permit it.

So, does this mean that when they pass secondary legislation they can then disconnect you without actually proving liability?

I love the way these laws are only to be used in the future and in special circumstances. Which is proven to be absolute codshit.

Case and point: Section 44 Stop & Search powers of the anti terrorism legislation. This allows stop and search of any individual without suspicion.

When it was going through we were assured it would only be used in extreme cases, and only for a short time, and only to help prevent terrorism.

It is in constant use in the whole of Greater London and has been for the last 9 years.

There is another issues:

The secretary of state can cut of someone's internet access for any consideration. It's not specifically tied to copyright infringement. So we could start seeing this legislation being used for other purposes. This could be used to cut the internet access of any material the secretary of state decides should not be downloaded.

MyWord... so they're not directly censoring information (that we know of) but they will have the ability to stop (and cut off) anyone downloading content they decide is 'unsuitable'.

When did I move to China? Freedom of information has lost a serious battle, dress it up anyway you like, we enter the new age of the virtual police state.
