Can we get our tenancy deposit back?

We have recently given a months notice to leave the property we have rented since 30th March 2007. The letting agents we were with originally went into liquidation a few years ago so now our landlord uses another agent. They have told us that we cannot have our deposit back as we moved in to the property before the 6th April 2007 when the Tenancy deposit protection scheme came into place, and the money was lost with the other company. Is this correct? Is there no way we can claim our deposit back?

Any help on this matter would be most appreciated.

Thanks :)

Think Teks right. I'm sure Vault girl will tell you as soon as she sees this, or if you search for the GDH thread I'm sure this sort of thing is covered in there.

I'm not positive, but I believe the deposit is always the landlords problem.
i read something like this on another thread last week. basically a private landlord decided to leave his house/tenants in the hands of an estate agent while he went travelling the world for 6 months ..when he came back he found out the agency had gone into liquidation..he had to pay all his tenants their deposites back . :)
