Warning, It Is A Pathway!!!!

For any of you Stafford folks who know about (and I beleive it to be) the only little bit of free parking left. Well, it is no longer. The little strip of land behind H.Samuel, and what used to be Dixons etc. I GOT A BLOODY TICKET. The warden reckons that the lines go from the road to the buildings ??????. As far as I was concerned the road the path is what the yellow lines cover. Now the council are claiming this IS a pathway. No warning was given, no signs (apart from the fact that i thought it was a little unusuall to actually find a space there on a busy Monday morning). I have been parking here as long as I have had a licence and my father before me and I have been driving for 22yrs. I have appealed and am waiting to hear from them. Cheeky beggars, they just want to take, take, take.

Anyway, I thought I should just warn any of you that use this spot.

I guarantee they will turn your appeal down.... if you push it then you have a good chance of getting it overturned but in my (unsubstantiated) opinion they automatically turn them all down to start with.

As a general rule, yellow lines apply to both the road and footpath/pavement adjacent. Signing doesn't have to state that cos parking on footpaths/pavements isn't allowed...

Or indeed anywhere in the Littleworth area, apparently. The two wheels on the road two wheels on the pavement brigade seem to have taken over.

Having looked into it I believe this is a grey area. Parking on the pavement is explicitly banned within the greater London area. Elsewhere it appears you can do it so long as you aren't an obstruction. What an obstruction is, is anyone's guess? An obstruction would be a police matter rather than the decriminalised parking regulation run by the council.

What isn't allowed is parking on the pavement where there are double yellow lines adjacent, and also where there are dropped kerbs.

The no parking by dropped kerbs rule is quite new and has only recently been adopted by parking enforcement in Stafford.

Confused, so am I.

Opposite Stafford Rangers the other week 3 wardons turned up to try book about 20-30 cars for parking on "double yellows" on adjacent pavements but also on the grass opposite the ground - because thats obstructing anything? Good to see there discouraging fans from coming, because if the car parks full they may have to park further away, and in bad weather this may discourage people attending if they can't park on some grass, it doesn't do any harm to anyone, so why try and book people for it, other than to make money.

And does it do any harm for people to park further away? No. The exercise will do them good. There isn't a god given right to abandon your car wherever you like. I seriously detest pavement parking, it is down right anti-social. Its just a shame that wardens can only issue PCNs for pavement parking where there are lines, it should be an offence full stop.

It is a grey area. Copy and pasting from a House of Commons library note:

"Despite the lack of a general ban on pavement parking a particular incident of pavement parking may therefore be considered dangerous or obstructive and may constitute an offence under one or other of the following statutory provisions:

• Section 137 of the Highways Act 1980. Section 137 makes it an offence to wilfully obstruct the free passage along a highway.
• Section 28 of the Town Police Clauses Act 1847. Section 28 deals with offences of wilfully causing an obstruction to any public footpath or public thoroughfare.
• Regulation 103 of the Road Vehicles (Construction and Use) Regulations 1986. Regulation 103 makes it an offence for a vehicle to cause unnecessary obstruction of the road (including footpath and grass verge).
• Section 22 of the Road Traffic Act 1988. Section 22 is concerned with the offence of
leaving vehicles in dangerous positions on the road (includes footway). "

Basically it needs a total ban bringing in. Round by me there's pavement parking everywhere, its totally idiotic. None of them bother to stop and think that if they were parked properly in the road, you could still drive a bus through the other way without any problem. Meanwhile there's barely any room for pedestrians to squeeze past on the pavement. Fat chance of the rozzers doing anything about it because they do it as well.

Was more on about the grass, people have parked there for decades. Yes it is a problem for some people walking further away, such as those who aren't that good on there feet.

i lived on peter james court for 18 months and i got so sick of selfish football fans parking their cars in the most inconvenient of places on the estate, mainly right by the entrance to the estate making turning left out of there a real problem.

What used to really piss me off every sunday morning was getting up and going to the shop on marston road to get some milk or whatever and noticing the estate full of cars parked in silly places (most of the estate is a car park ffs why park on the road a block it up for everyone?!) only to walk past the rangers' car park to see it only half full. the PJC resident's association has raised it several times with SRFC although I moved away over 12 months ago now and have no idea what, if anything, every came from it.

I suspect there is a fee for parking at the rangers, probably a couple of quid during a match and people would rather just abandon their cars with no thought for anyone else.

Opposite the old sgi adjacent to the pavement next to where retired folk apts are is a bus stop to the front and rear of the raised passenger egress are spaces to park all day every day for free i think a local resident has baggseyed one of them as one parked car dunna move from one day to the next another free parking spot is next to the residential building close to the rac windscreen replacement establishment at weekends the magistrates car-park often has it's barrier raised and if that's the case then i usually park there without any problems quite often cars are parked to the rear of maccdys never seen any regulatory notices so maybe its a see the space and park scenario however the way things are going if you park within the town centre best put it on a car-park or basically you will be done for £45...........:xmas:

You can park, for half an hour, I think, outside what was Radio Rentals, now Caffe Nero, behind the bus-stops near Plumbits - if you can find a space there.

Fair enough Shoes... thats different entirely. The car park is usually full though. But I'd hope people still don't do that.

I was being sarcastic about it being a pathway,the shop staff have been parking there for years. Now the council want to call it a path. It's like they sit around a table and say ' hmm, where can we piss people off today and get more money out of them at the same time, I know, lets call that a footpath and ticket them for parking on it.'

There's a few spots on White Lion Street, if it's still called that - the short stump of a road on what used to be Attwood's roundabout, or the island with the vet's on, as it is probably known now....

Or maybe it's Kwikfit Island?..

Interestingly (old chestnut)...the council made Corporation Street a place where you could park on the pavement half and when they devised that "safe" traffic calming project down that road...
