1. When will my membership start?
Your membership will start on the date given on your membership agreement form.

2. How long will my membership last?
You will be a member for at least the minimum term given on your membership agreement form. Your membership will continue automatically after your minimum term unless you write to us to give us at least three full months’ notice that you want to end your membership. Please read section 7 below.

3. What do I need to know about paying my membership fee?
You need to pay your full monthly membership fee in advance (for the month to come) by direct debit.

3a. Paying by direct debit
If you pay your membership fee monthly by direct debit, this will be taken from your bank account on or around the 3rd working day of every month.

3b. Any other payment methods
If you pay your membership fee by any method other than direct debit you need to pay no later than the last day of the previous month, and you will be charged an admin fee for this.

3c. What happens if I don’t pay my membership fee on time?
If you don’t pay your membership fee on time, we or our processing agent will write to tell you. You will be charged a one-¬off non-¬payment fee for this. You will not be able to use the club facilities until you have paid what you owe us.

If you still don’t pay, you are breaking this contract. We could refer any missed payments to a debt collection agency and claim compensation from you for an amount equal to the total membership fees, including fees you owe for the rest of the minimum term, or, if the minimum term has expired, the notice period.

3d. Fee changes
We review our membership fees from time to time. Any changes to our fees will generally apply from 1 January each year. We will give you at least 30 days’ written notice of any such changes. If we increase your membership fee (excluding VAT) by more than the rate of inflation plus 5% in any 12¬month period, you can resign from your membership by giving us three full calendar months written notice. You must make sure we get this notice within one month of the date we tell you about these changes.

4. Joining fee
We can’t refund your joining fee. If we cancel your membership for any reason or you end your membership, and you want to rejoin Esporta in the future, you will have to pay the joining fee again.

5. Other charges
We will charge up to £50 to cover our costs for the following.

■Sending you letters about failed payments
■Referring what you owe us to a debt collection agency
■Replacing lost membership cards
■Transferring your membership
■Putting your membership on hold and starting it again
■Dealing with membership fees which are not paid by direct debit
■Administration costs to cover things such as confirming your identity.

6. Can I put my membership on hold?
During your minimum term we may let you put your membership on hold if you have a medical condition that stops you from using the club facilities. We will put your membership on hold for between three and twelve months. We will need to see proof of your medical condition, such as a doctor’s certificate.

We will add any periods your membership has been on hold to the end of your minimum term.

Outside your minimum term we may let you put your membership on hold once in any twelve month period for between three and twelve months. We would have to approve any membership being put on hold. We may ask for proof of your circumstances and you may have to pay a monthly fee to do this.

You can only put your membership on hold for full calendar months and you must give us one full calendar months’ notice in writing by the 15th of the month before you want to put your membership on hold. Notice to end your membership cannot run if your membership is on hold.

7. How can I end my membership?
If you want to end your membership, you must give us at least three full calendar months’ notice in writing so that your membership will finish at the end of the third month. For example, if you tell us on 1 June, your membership will end on 31 August, and if you tell us on 8 June, it will end on 30 September.

If you tell us during the minimum term, your membership will finish at the end of either the minimum term or the three month notice period, whichever is later.

You are responsible for making sure that we have received your written notice.

8. Ending my membership during the minimum term for medical reasons, because I’m moving house or because I’ve been made redundant
We may let you end your membership before the end of the minimum term on three full calendar months’ written notice after you have been a member for more than three months if you:

a. have a medical condition that stops you from using the club facilities;

b. move house and your new home is more than 20 minutes’ drive from an Esporta club, as measured by the RAC route planner; or

c. are made redundant.

We will need to see proof of these circumstances. You are responsible for making sure we have received your written notice and any proof of your circumstances. For more information visit www.Esporta.com

9. Can I use other Esporta clubs?
If you have paid for Esporta Freeway you can use some other Esporta clubs, depending on our policy in place at the time. You will have to pay a guest fee at some clubs.

We will ask you to transfer your membership to the club you use most in any three month period. You will have to pay the membership fees at the club you transfer to. You can find details of our current policy on the club notice board or on our website at www.Esporta.com

10. Transferring my membership
You can apply to transfer your membership to another Esporta club. We will need one full calendar months’ written notice by the 15th of the previous month for you to do this and you will have to pay a fee. Membership at your new club will start on the 1st of the following month. You will have to pay the membership fees at the club you transfer to and different terms and conditions may apply. You can find details of our current policy on the club notice board or on our website at www.Esporta.com

11. Club ownership
If the club gets new owners, your membership will transfer to the new owner. You will carry on as a member of the club and pay your membership fees as normal. You may no longer be able to use other Esporta clubs. If a club that you only use occasionally gets a new owner, you may no longer be able to use that club.

12. Can my partner join on my membership?
Your partner may be able to join the same club on your membership if you are both living at the same address (we may need proof of this). Members who join in this way are both legally responsible for the payment of all membership fees. You may also add children, nannies and carers to your membership.

13. My membership package
You are responsible for making sure you are on the membership package that best suits your circumstances. If your circumstances change, it is up to you to inform us and to ask us about our current membership packages. You cannot downgrade your membership package during your minimum term.

14. Our facilities
We may need to change our opening hours or the facilities available at the club, for example for cleaning, refurbishment, repairs or for special functions. If possible, we will put notices up if we are planning to do this.

If a large part of the club’s overall facilities is not available for at least 20 days out of 60, you may be entitled to an appropriate refund.

15. What happens if I change my mind?
You can cancel your membership by giving us written notice within 48 hours of signing the membership agreement form (unless you use your membership in this time). We will not refund your joining fee.

16. What happens to my personal information?
We are registered under the Data Protection Act. We take our responsibility for looking after your personal information very seriously. You can find out how you can see the information we hold about you, or how to ask us to change this information, in our privacy policy. Our privacy policy is available on the club notice board or on our website at www.Esporta.com

For security reasons you must agree that we can take a digital photograph of you and anyone else on your membership. You are responsible for telling us about any changes to your personal information.

17. Our right to cancel your membership
We will cancel your membership straightaway if you, or your guests, seriously or repeatedly:

a. break these terms and conditions or club rules;

b. put the health, safety or well-being of our staff or other members at risk;

c. let other people use your membership card to get into the club; or

d. engage in disruptive or violent behaviour

If we cancel your membership you still have to pay your membership fees for the notice period and, if it applies, the rest of any minimum term left.

We have the right to cancel any membership at any time.

18. Our responsibility to you
We will not be legally responsible for any possessions you lose, or that are damaged or stolen by anyone, unless we have been negligent. If you have an accident or injure yourself at the club you must report this to the club straightaway (if possible), or at least within 48 hours.

We do not limit liability for death or personal injury caused by our negligence. If we are legally responsible for any other kind of loss or damage you suffer, we will pay you compensation of up to £200.

19. Changes to these terms and conditions
We may change these terms and conditions. We will tell you about any changes on the club notice board and on our website. If we change our terms and conditions, the new version will apply straightaway.

20. The terms of my contract
These terms and conditions, the membership agreement form, the club rules and the parental guarantee make up the whole contract between us and you.

It is important that you read and understand all of these documents and are happy with the information in them before you sign your membership agreement form.

If you do not have any of these documents, please ask us and we will give them to you.

These terms apply to all our members.

Resigning from my membership because I am moving house or have been made redundant
Moving House
Within our terms and conditions of membership we agree that if you move house we may accept your contractual period of notice to resign your membership, even if the end date of your resignation falls within your minimum term.

This condition is subject to:

1) your having been a member of the club for a minimum period of 3 months with no membership fees outstanding; and,

2) your new address not being 20 minutes travel by vehicle as per the RAC route planner is considered reasonable travelling distance.

We will require proof of moving house before accepting your resignation.

Examples of proof can include - a utility bill, mortgage statement, tenancy agreement or similar confirming your new address.

Redundancy
As per the terms and conditions of membership we agree that if you are made redundant we will accept your contractual period of notice to resign your membership of the Club, even if the consequent date of your resignation falls within your Commitment Period.

This condition is subject to:

1) your having been a member of the club for a minimum period of 3 months with no membership fees outstanding;

Alternatively, if you are made redundant, you may choose to suspend your membership for a maximum of three months at no charge. We will add any period your membership is suspended to the end of your minimum term.

We will require proof of redundancy before accepting your resignation.

Examples of proof can include – written notification from your employer.

Use of other Esporta clubs
Our members can use some other Esporta clubs, subject to a joining fee being paid at point of sale.

Non Premium club members
Any member of Esporta may use any Esporta club, with exception of the Premium clubs, free of charge.

Premium clubs charge an entry fee for non Premium club members. The fees vary depending on the club you are visiting.

Premium club members
If you are a member of a Premium club you may use any club, including other Premium clubs, free of charge

Esporta’s terms and conditions require that a member must transfer (and take on the fees) of the club they use most often in any three month period.

Can my partner join on my membership?
We may also refer to a partner member, as an associate member

As an adult member of Esporta you are permitted to join a partner member onto your membership.

■You and your partner must live at the same address;
■Partners must be the spouse or dependant child of the head member.
■Concessionary packages are also available for Nanny’s/Carers (this varies between clubs).
An adult partner joining on your membership is required to sign the membership agreement form and commit to a minimum term of contract.

By signing the Membership agreement form, both adult members are legally responsible for the payment of all membership fees.

Partners/associates not permitted
Outside of spouse/partner and dependant children the following associations are not permitted:

■Friends
■Colleagues
■Relatives (e.g. sibling, cousin, parent of the primary)
The following membership types are not permitted an associate membership:

■Under 18’s
■Students
Payment of your membership
The Direct Debit is always set to the Primary member and all partner/associate membership fees are taken from the same Direct Debit.

Any resignation request that is accepted for one member does not automatically apply to the associated members. Each member must complete their agreed minimum term period.

Any resignation of either adult membership automatically dissolves any applicable partner rate and prevailing rates will become payable.

If a primary and a partner member wish to dissolve their association then they must both sign a membership split form agreeing to become individually responsible for their own memberships.

Guest fee – up to £30 (prices vary from club to club)

Non Direct Debit membership payments - £5

Failed membership payment charge – £20

Referral to debt collection agency charge - £40

Transfer of membership fee - £10

Suspension of membership fee - up to £20 (prices vary from club to club)

Replacement membership card - £10

Transfer of membership
You can apply to transfer your membership to another Esporta club, but we will need one full calendar months' notice in writing by the 15th of the previous month for you to do this. Transfers start on the 1st of the following month and you will have to pay a fee. You will have to pay the prevailing membership fee at the club you are transferring to.

Esporta Free Guest Pass Offer Terms and Conditions
1.The free guest pass entitles an Eligible Person to enjoy complimentary access at one Esporta club in the UK (not including Brighton, Chiswick Riverside, Clearview, Northwood, Royal Berkshire & Swiss Cottage) for one day. Please note that opening times differ from club to club. Please see www.esporta.com for full details. Additional services (such as personal training sessions or Tranquillity Spa treatments) are available on payment of the appropriate fees.
2.The free guest pass may be redeemed by appointment only. Please call or register your interest via our website at your chosen Esporta club to make an appointment (contact details available on our website www.esporta.com).
3.Esporta reserves the right to refuse entry to any person if it suspects abuse of this offer or otherwise in its reasonable discretion.
4.Use of a guest pass is subject to satisfactory completion of a medical questionnaire and acceptance of the club rules (available at any club and on our website).
5.The guest pass is non-transferable, non-exchangeable and cannot be redeemed for cash.
6.Esporta reserves the right to withdraw the complimentary visit offer at any time without notice.
7.Redemption of a guest pass shall mean that Eligible Persons will be deemed to have fully and unconditionally accepted and agreed to be bound by these Terms and Conditions and Esporta’s decisions.
8.This offer is governed by English law and is subject to the exclusive jurisdiction of the English Courts.
9.Esporta is not liable for the reproduction of this offer or indirect access via third party websites or otherwise of these terms and where such reproduction misstates or omits any of the information or terms and conditions connected with this offer.
10.Nothing in these terms and conditions shall be deemed to exclude or restrict any of the Eligible Persons’ statutory rights as a consumer. Details are accurate at time of print.
