National Fraud Initiative

This authority is required by law to protect the public funds it administers. It may share information provided to it with other bodies responsible for auditing or administering public funds, in order to prevent and detect fraud.


The Audit Commission appoints the auditor to audit the accounts of this authority. It is also responsible for carrying out data matching exercises.


Data matching involves comparing computer records held by one body against other computer records held by the same or another body to see how far they match. This is usually personal information. Computerised data matching allows potentially fraudulent claims and payments to be identified. Where a match is found it indicates that there is an inconsistency that requires further investigation. No assumption can be made as to whether there is fraud, error or other explanation until an investigation is carried out.


The Audit Commission currently requires us to participate in a data matching exercise to assist in the prevention and detection of fraud. We are required to provide particular sets of data to the Audit Commission for matching for each exercise, and these are set out in the Audit Commission’s guidance.


The use of data by the Audit Commission in a data matching exercise is carried out with statutory authority under its powers in Part 2A of the Audit Commission Act 1998. It does not require the consent of the individuals concerned under the Data Protection Act 1998.

We just spoke.
We have now received a third party EIASCR request for the above application.This has come in from the same
person that has requested call in.
The Secretary of State now needs to assess the request, obtain necessary documents and would then usually require
a period of 21 days in which to assess the request.
I’m aware that you are planning to take this case to committee on 30/3/16.
It is up to you how you proceed from here on in…
You could either continue to take it to committee and then await the SoS’s decision on the EIASCR request. This
would mean we will issue you with an A31 Holding Direction next Thursday or need to enter into an informal
agreement whereby you promised not to issue the decision, should the recommendation be to approve, until such
times as we complete our consideration.
Or, you could decide to withdraw it from committee.
The choice is yours and we are not able to advise you either way. We simply need to tell you what is before us.
Once you have taken advice and decided which option to take, please can you let me know what you decide to do?
My next day in the office is 31/3/16. But my absence should not affect any decision you are about to take.
You can always call 0303 444 8050 and ask to speak to another member of Central Team in my absence if there was
anything urgent.

We spoke this morning and you kindly brought me up to date with the position of this application. And I note you are
on AL until 4/4/16 after Friday, hence I’m cc’ing Richard in.
I understand you are taking it to Committee on Wed 30 March.
As I explained, the Secretary of State has a letter requesting ‘call in’ of this application. I will be sending a holding
reply to the writer, advising that we will be taking no action until such times as this application has been to committee.
In general, we consider that it is inappropriate in these cases to consider whether intervention at Government level is
appropriate until the Council has reached a clear recommendation, taking into account the views expressed by
consultees and the local community. In the event that your Council is minded to approve the application, following
committee, we will then consider the request along with any other issues raised by the application against the call-in
policy set out in the Ministerial Statement of 26 October 2012.
We would then need a period of time to assess this request, post committee. You mentioned that there is no S106 on
this application, so it is likely that you could be in a position to issue the planning permission quite quickly. We may
therefore, depending on the outcome at committee, need to issue an Article 31 (previously 25) Holding Direction, to
you on Thursday 31 March, formally preventing your authority from issuing planning permission. Or we could agree
an informal arrangement.
We agreed I would keep in contact with Richard in your absence and I will call him on the am of 31/3 to establish the
outcome of the Committee.
I hope this is clear. Please don’t hesitate to contact me with any queries in the meantime.

New twist in saga of Stafford Rugby Club's home
Contentious plans to relocate Stafford Rugby Club may now being called in by the Government - adding another twist to the ongoing saga.

The Department of Communities and Local Government Secretary Greg Clark MP has been asked to look at the proposal to move the club from Newport Road, Castlefields, to Blackberry Lane, near Doxey Marshes.

It would give Westminster bosses the final say on whether it should go ahead or not.

The DCLG wrote to Stafford Borough Council stating it would be 'inappropriate' to intervene prior to Wednesday's planning committee meeting to decide on the scheme.

But the department also declared if the plans were approved they may order them to freeze the decision while the Government's National Planning Casework Unit reviews the matter.

In a letter to the council Karen Partridge, planning casework manager for the DCLG, said: "In the event that your council is minded to approve the application, following committee, we will then consider the request along with any other issues raised by the application against the call-in policy set out in the Ministerial Statement of 26 October 2012."

Campaigners who have vehemently opposed the scheme all along have welcomed the latest development.
Tony Pearce, chairman of the Castletown Resident's Association, said: "We have nothing against the rugby club and in a way we sympathise with them. Moving the club would be good for them and the town. It is just that this location (Blackberry Lane) unfortunately is wrong.


"We are quite confident the Government would turn this down."

The council have already given the green light to the scheme once only to quash their ow decision after the residents threatened to take the matter to a judicial review over complaints surrounding the planning processes followed.

Mr Pearce said the group had further grounds to call for another judicial review if the scheme was passed for a second time but stated they would listen to legal advice first.

"There is just no way this planning application can be approved under the existing framework," he added.

Martin Lennon, director at Stafford Rugby Club, welcomed the possibility of the Government's involvement.

He said: "I don't think there is grounds for it to be called in but personally I hope the Secretary of State will end up dealing with it. Council officers have recommended it for approval and the issues have been about their processes.
"I suspect the Secretary of State will be more robust than the council."
