Awful hit and run this evening.

Surely driving without due care and attention? You're supposed to drive to the conditions, so if a light was out he should have slowed?

The legal side of it is, the driver has never been charged due to a street light being out so therefore lighting was poor
FFS... Is there no justice in this world?!
If he couldn't see well enough to see two people then he shouldn't have been driving - were his headlights not working?

If street lighting was out then this is the responsibility of the County Council (if I remember rightly) so if this is what caused the accident then they were gravely (thankfully not literally) negligent.

Also, why anyone would need a 4x4 to drive around Stafford is beyond me - they should be banned in urban areas, and bull bars (did this vehicle have them by any chance?) should be banned full stop.

</righteous rant>

He should have, but unless he was driving above the usual speed limit (i.e. 30 mph I presume) then the driver has not broken the law. I had the same when a driver knocked me over in extremely wet conditions - he was going at the speed limit, and skidded into me (apparently). The only thing you can do is go through the civil claims court.

It's good to know that mother and daughter are doing well and are still here to celebrate christmas this year.

I would have to say that anybody who drives should know that it is difficult enough to see pedestrians when they are on a busy road and lots of car lights, you could call it night blindness, Vision is severely impaired and you have to be extra vigilant, broken light or not. I would like to know one thing. If the driver is not at fault and it has been put down to faulty lighting then surely the council must be to blame. Personally I think blame should be portioned.

I didn't personally know of the mother & daughter concerned at the time, but since learned that the woman is a very old close friend of my wife's.
Since the accident they have regained contact, and i've now had the pleasure to meet Becky and Katherine.
What they have survived is a "true miracle" and as Miss T said, they are both very determined people to live a completely normal life as best they can.

All I can say is this. Becky & Katherine are both truly inspirational people, and it makes you think about how valuable every persons life is... whether you know somebody or not.

I'd like to raise a "virtual glass" to them both and hope you all join me in wishing them a WONDERFUL CHRISTMAS which I think they absolutely deserve!!

PS - Will refer Becky to this thread incase she'd like to read through it

Sorry but the driver should be charged...as Tek says driving without due care and attention..even if he was going correct speed he wasnt driving correctly...anyone who learns to drive knows there is a certain level of responsibilty we have to go through and even when the lighting is good I dont think for a second about anything but being safe and making sure others are safe...

Hope the family are ok Miss T and I hope they have as best a Christmas as they can, just hope this whole thing still means they can enjoy things that we all take for granted

Agree with your post and just wanted to say that even if he was within the speed LIMIT doesn't mean he is not in the wrong.

The speed LIMIT is just that, a LIMIT not a target. You still have to judge the conditions and adjust your speed accordingly.

And surely if it was a hit and run he can be done for failing to stop.....

And didn't he mount the pavement too? I have driven on plenty of roads without streetlights but never once mounted the pavement.

Unfortunately, according to the law, it does mean he is not in the wrong - I know, it's poo...

Thanks Dawn, I am sat here in work near enough in tears of sadness at the thought of what Becky and her daughter went through and then I am near enough shedding tears of happiness that they are both still here to tell the tale and are looking on the brighter side....

Best wishes to all!!!
