So in a nutshell theyre folding the business and transferring the assets to a new company under a different guise and letting the taxpayer foot the bill for its debts? Nice. If thats the case i know where they can stick their bananas!

There seems to be some unpleasant comments made on the forum about this subject. This is not what the forum is all about. That sort of behavior is best saved for Facebook.

What is clear from all the threads is that the employees were treated disgracefully, whether or not that was because of advice taken on insolvency or not, it is still appalling to treat long serving loyal staff in that way; I hope that the ex-employees get some redress from the NI fund.

There does seem to be some underhand practice in the closure if all the assets have been transferred to the new business whilst wages and redundancy pay was outstanding to staff. The assets should have been sold to pay them.

I’m sure that everyone can sympathize with a company struggling and going under – but there seems no logic to open again if they were not turning a profit and if rent was owed it would have been owed by the old company and therefore a debt - not somthing the new compnay had to worry about.So should not have been in the equation when thinking of how to pay the rent.

If they did take advice they would have also been informed of the following statement:

There is absolutely no legal requirement to put an insolvent company into voluntary Liquidation and certainly no legal requirement to appoint an IP. Effectively all that is required in law is that a company finding itself to be insolvent must cease to trade, and that all creditors must then be treated equitably.


That includes the staff!!!

That makes everything ok then, i hope there staff and the companies they owe money to read this because it makes everything ok, ill will pass this on to my mate who worked there for over 12 years it will cheer him up thanks.

Without wanting to sound rude Arthur, have you read all the other posts on this Forum?
This is a place for Staffordians, old and new, to express their own personal feelings about each and every subject on here. Occasionally our lovely Admin has to step in and pull us up, not very often tho. I'd hate to think I couldn't come on here and say what I think in case it upsets someone.

That is the nature of internet forums.

In fact this forum is very well behaved compared to most others. I'm head mod on another forum and that's like juggling piranha fish.

Yes that’s why I like this forum, because the participants all seem friendly - somewhat mad, it has humour, news and everyone seems so supportive of each other.

Essentially most people saying its terrible, a small minority saying to shut up and one really happy to have lost her job cos apparently she's due 8k redundancy (which we will fund as taxpayers). Of the defenders one is the partner of someone who used the exact same tactic to dodge debts a few years ago, although he kept on his staff.
